Source description

Support: White marble slightly tapering stele, reddish from earth, cut off on a large central part of the upper edge, leaving two 'horns' at each end, also chipped off partly on both lateral edges and broken off at lower right angle, which shows hints of fire (w: 0.545-0.565 × h: 1.5 × d: 0.28-0.30).

Layout: Inscribed on the face with some paragraphoi, most of which are now lost but may be restored because of a slighlty higher space between the lines.

Letters: Average 0.007, except: line 1 0.01; line 55 end, line 72 end and line 73 0.085; still rubricated in some parts; slanting mu and sigma, smaller omicron.

Date: September (Criscuolo) or spring (Rosamilia) 320 BC (reign, prosopography).

Findspot: Found by Ferri in 1922 at Cyrene: reused as a step leading to the southern cold pool of the Byzantine Baths.

Place of origin: Cyrene, probably Sanctuary of Apollo.

Last recorded location: Cyrene Museum, 11. Seen by Dobias-Lalou many times between 1976 and 2010 in Shahat: Cyrene Museum.

Apparatus

1-88: Rosamilia 2023's new edition is based upon partial autopsy of the stone and complete study of an ancient plaster moulding. We did not register here all minor differences with IGCyr, from unclear to supplied character, nor from formerly seen to now lost.

The politeuma should consist of the Ten thousands; should also be part the exiles having taken refuge in Egypt whom Ptolemy will appoint and those who are in possession of everlasting belongings estimated (10) with those of their wife at twenty mines of Alexander, provided that the evaluators estimate them mortgage-free; furthermore those who hold debts valuated twenty mines of Alexander with everlasting belongings of their wife estimated not lower than the debt plus the tokens — and those indebted should confirm the debts upon oath — and even if their neighbours are deprived of rights, those will also be part of the Ten thousand, if they are older than thirty years of age. The gerontes should choose as evaluators amongst the Ten thousand sixty men older than thirty, after having sworn the customary oath. Those who will be chosen will carry out the evaluations by enforcement of the laws; for the first year, one will be a citizen in accordance with the past evaluations.

The council should consist of five hundred drawn amongst the citizens aged more than fifty; they should act as councillors for two years and on the third year they should draw out half of them; these should leave their office for two years. If the total is not fulfilled, the missing number will be drawn amongst those aged more than forty years.

(20) Should be [gerontes] hundred and one citizens whom Ptolemy will appoint; in case of death or failure, the Ten thousand should elect another member aged more than fifty years in order to complete the hundred and one. It will not be allowed to elect a geron for any office but strategy in wartime. The priests of Apollo will be chosen amongst the gerontes who have never fulfilled the priesthood and are aged more than fifty years.

Ptolemy will be strategos for life. Furthermore five strategoi will be chosen amongst those who have not yet taken on that duty and aged more than fifty years; but in case of war, amongst the whole politeuma. If another war occurs, except a war against Libyans, the Ten thousand should decide whether (30) the same will be strategoi longer or not; if not, they should be chosen amongst the whole politeuma.

There will be also nine nomophylakes chosen amongst those who have not yet taken on that duty.

The gerontes should do what the gerontes did in peace time, the council should do what the council did, the Ten thousand should do what the Thousand did. All cases with a risk of death penalty should be tried by the gerontes, the council and one thousand and five hundred men drawn amongst the Ten thousand; they should use the former laws, provided that they do not infringe the present diagramma. The public offices should be liable to rendering account according to the existing laws. Someone who will be brought to trial by the strategoi and charged by the gerontes and the council with risk of death penalty (40) should be allowed to choose whether he will be tried either according to the laws or before Ptolemy, this for three years. Afterwards, the trial should be made according to the laws. But against the exiles no sentence should be allowed without Ptolemy’s advice.

Any member of the civic body who publicly practises as physician or paedotribes or teaches archery, riding or fighting in arms or acts as herald in the prytaneion should not be allowed to perform at the same time an office open to the Ten thousand, whoever is practising one amongst those professions.

I gerontes facciano ciò che i gerontes facevano in tempo di pace, il consiglio quello che faceva il consiglio, i Diecimila quello che facevano i Mille. Tutte le cause che prevedano la pena di morte le giudichino i gerontes, il consiglio e millecinquecento fra i Diecimila, estratti a sorte. Commentary

This is a new edition of an important and much discussed inscription. Generally speaking, the text frequently referred to has been that of SEG, 9.1, which is said to be based upon Oliverio's readings. However, Oliverio very cautiously had given whole phrases as unclear, a fact that was obliterated in the following edition. Fraser and Laronde, each of them for different parts of the text, came back to more reasonable positions. Independently from a personal observation of the stone by Dobias-Lalou, the present edition is based upon the photographs taken at the time of the discovery. For a few points, we agree with readings of Ferri, that Oliverio had eliminated. And where Oliverio's readings seem too hazardous, we prefer not to write down what seems to be severely damaged.

In this commentary it is impossible to discuss all the historical implications of the diagramma, for which the bibliography will be helpful (see lately Bencivenni 2003, pp. 105-149). About the date, in addition to Criscuolo 2001, see also Rosamilia 2023, p. 36, footnote 124. The following notes are restricted to points deserving discusssion for establishing the text and to prosopographical implications later than those already exposed by Laronde 1987, pp. 85-128 and passim.

At line 1, of which nearly nothing survives, Oliverio restored the formula that stands ahead of IGCyr0110002 and is usual for Attic decrees. But it is far from certain that such an invocation to the Good Fortune would have stood here. Anyway, the taller letters seem to show that this was some sort of title.

At line 5, Oliverio's emendation into δέξηται is not necessary. The short vowel may be explained either as parallel of other uses of the future with ἄν in Attic and the koine or more plausibly as a reminiscence by the stone-cutter of the subjonctives with short vowel of the local dialect. Other such mistakes were duly mentioned by Fraser: τός at line 22 and 69, αὐτός at line 30, ἐννῆ at line 32, subjonctive λιθουργήσει at line 48 and probably the infinitive ὑποθέμεν at ll. 61-62.

Line 6, the politeuma is a group of citizens with full political rights vs the 'ordinary' citizens mentioned at line 2.

At line 25 the singular νεώτερον is very clear on the stone. In fact, the plural at the beginning of the sentence is used in a general prospect, whereas the singular of the adjective refers to each annual choice of only one priest.

At line 41 τὸ λοιπόν may apply to the duration of the special treatment (hence 'afterwards') or to the type of case (with death-penalty or else).

Lines 46-72 correspond to the part where the re-use occasioned the most severe damages. We agree with Fraser that the much smoothened surface can offer no certain restoration and that «any attempt to recover more than the most general sense must be abandoned». We thus follow most of his cautious readings, especially restoring at line 47 προδικία, rather than the alternative ὑποδικία, plausibly derived from ὑπόδικος 'liable to be tried', both fitting an ἀτιμία .

At line 63 Πτολεμαίωι, although ending with ωι can only be a genitive. This is a very early occurrence of a confusion that becomes more frequent in the Roman period.

At line 74, the first mentioned strategos is Kallippos son of Melanippos. The man mentioned in the epitaph IGCyr0870002 is probably his son and should be added to the stemma of the family (see Laronde 1987, p. 117).

At line 76, the last name is restored as Στράτων by others; however Στράτος and Στράτις, also attested in Cyrenaica, are quite possible.

At line 79 the name of the second man mentioned might be restored either as Πρᾶτις or Πρῶρος. However, as his father has the very rare name Κυρβασίας, it is highly probable that he was related to Κυρβασίας Πράτιος mentioned on a funerary base (IGCyr0254002) not later than ca. 275 BC.

At line 80, the restoration Ἁγήσανδρος Κ[λεάνορος] is based upon IGCyr0959002, l.1.

At lines 83 and 86 the same man, Pratomedes son of Philippos, is acting as ephoros and nomothetes; he should be also mentioned as a commander of cavalry at IGCyr0840002, l. 13. We have now also his epitaph (see IGCyr1208002).

At line 87, the restoration of the father's name of Androkles son of Callimachos is based upon the fact that two other nomothetai are also mentioned before, Hagesistratos son of Nikasios being also a nomophylax and Pratomedes son of Philippos being also an ephor. Thus the assumption that the nomothesia was no ordinary office and could be took on as a supplementary duty (see Laronde 1987, p. 99).
